These Terms and Conditions of Sale apply to purchases made by consumers from MALAM through createur-de-mode.net.

2. MALAM garments and products

The products available for purchase are those displayed on createur-de-mode.net, subject to availability.

MALAM garments are made in France. Depending on the information given on each product page, they may be available in stock, produced in small runs, made to order, made to measure or personalised.

The main characteristics of each item are described on its product page. Every effort is made to represent colours and materials accurately in photographs, but slight differences may occur due to screen settings or the individual characteristics of fabrics and materials.

Some fabrics and materials are available only in limited quantities, particularly for one-off pieces and small runs. The possibility of reproducing a design or making it in a particular fabric therefore depends on the materials available at the time.

If an item or material unexpectedly becomes unavailable after an order has been placed, MALAM will contact the customer and, depending on the circumstances, offer an alternative or a refund for the item concerned.

3. Placing an order

Customers select the items, sizes and any available options they wish to purchase and add them to their basket. Before confirming the order, they can review its contents and total price and correct any errors.

Confirming an order means accepting these Terms and Conditions and creates an obligation to pay. An order confirmation is sent electronically once the order has been placed.

For made-to-order, made-to-measure or personalised pieces, the options selected and information supplied by the customer are used to make the garment. Customers should therefore check all sizes, measurements, fabrics, colours and options carefully before confirming their order.

MALAM offers alterations and personalisation based on existing MALAM designs. MALAM does not offer a service for creating an entirely new garment from a design, photograph or idea supplied by the customer.

4. Prices

Prices shown in the shop are in euros and include applicable French VAT, unless otherwise indicated. Delivery charges, where applicable, are shown separately.

The price charged is the price displayed when the order is confirmed, including any selected options.

Certain options, alterations or personalisation may carry an additional charge. This is shown before the order is confirmed or, where a particular request needs to be discussed first, quoted to the customer before they agree to proceed.

Any applicable delivery charges are shown separately before the order is finally confirmed.

5. Payment

Payment is due when the order is placed.

The payment methods available online are shown at checkout and may vary by country. Online payment may include bank card and PayPal. Where offered by PayPal, payment in instalments may also be available subject to PayPal’s own terms and eligibility requirements.

MALAM also accepts payment by bank transfer, French bank cheque and CADHOC gift vouchers. If these methods are not offered directly at checkout, please contact MALAM for payment details.

Electronic payments are processed by the payment providers available through the shop. MALAM does not receive or store customers’ full bank card details.

An order is considered paid once online payment has been confirmed or, for payment by cheque or bank transfer, once payment has actually been received.

6. Making times and deadlines

For pieces made to order, the estimated making time is shown on the product page and/or when the order is placed.

Making times are given in business days and may, for example, be stated as “ca. 4 business days”, “ca. 8 business days” or “ca. 15 business days”. These are estimates based on normal workshop conditions.

If an order contains several pieces that need to be made, the time required for the complete order may be longer than the making time shown for a single item. The timeframe shown or agreed for the order as a whole will apply.

Where an express making option is offered on a product page, the corresponding timeframe applies under the conditions stated when the order is placed.

If an item is needed by a fixed date, particularly for a wedding or another event, please contact MALAM before placing the order so that the deadline can be confirmed. Simply adding a requested date to a message or order comment does not in itself mean that MALAM has agreed to meet that date.

7. Delivery

Delivery destinations and methods

MALAM delivers to the destinations offered by the shop at the time of ordering. Available delivery methods may depend on the destination, the contents of the order and the services offered by the carrier.

Any delivery restrictions and applicable charges are shown before the order is confirmed.

Delivery charges

Delivery charges are shown before the order is finally confirmed.

For delivery to mainland France, standard delivery is free when three or more MALAM pieces are ordered. The shop can only apply this offer once a delivery address has been entered, so delivery charges may appear temporarily in the basket until the destination is known.

For other destinations, reduced delivery charges may be offered when three or more pieces are ordered. Where such an offer is available, the applicable conditions are shown in the basket or during checkout.

Delivery times and tracking

Where an item needs to be made, the overall delivery timeframe consists of the applicable making time plus the transit time for the selected delivery method.

Customers are notified when their order is dispatched and receive a tracking number or tracking link where available.

If delivery is delayed beyond the date or timeframe agreed for the order, customers retain the rights available to them under applicable consumer law.

Lost or damaged parcels

If a parcel is not received, is lost or arrives damaged, please contact MALAM promptly with the order number and, where relevant, photographs showing the condition of the parcel and/or its contents.

MALAM will make the necessary enquiries with the carrier and provide the appropriate solution in accordance with the customer’s legal rights.

Customs duties and import charges

Orders delivered outside the European Union may be subject to customs duties, import taxes or customs clearance charges on arrival, depending on the rules of the destination country.

Where applicable, these charges are not included in the order price or delivery charge unless this is explicitly stated at checkout. They are determined by the relevant authorities and/or operators, and MALAM cannot know their amount in advance.

8. Right of withdrawal for non-personalised items

Where the statutory right of withdrawal applies, consumers have 14 days from receipt of the goods to exercise that right without having to give a reason.

If several goods from the same order are delivered separately, the period runs from receipt of the last item.

The customer must notify MALAM of the decision to withdraw before the end of this period, either by using the withdrawal form provided or by making any other clear statement expressing the decision to withdraw.

For contracts concluded online, any online withdrawal function made available on the website may also be used in accordance with the applicable legal requirements.

Returning an item

After exercising the right of withdrawal, the customer has 14 days to return the item.

The direct cost of returning the item is borne by the customer.

The customer may be liable for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the item.

Refunds

When the statutory right of withdrawal is validly exercised, MALAM will refund the amounts due, including the original delivery charge corresponding to the standard delivery method offered, within the time limits and under the conditions required by law.

If the customer selected a more expensive delivery method than the standard option offered, the additional delivery cost is not refunded.

MALAM may withhold the refund until the goods have been received back or until the customer provides evidence that they have been sent back, whichever occurs first.

Refunds are made using the same payment method used for the original transaction unless the customer expressly agrees to another method that does not incur any fees.

Partial returns from an order that qualified for free delivery

If an order received free delivery because a minimum number of pieces was purchased, and a partial return means that the number of pieces kept falls below that minimum, the free-delivery offer no longer applies.

The standard delivery charge that would have applied to the items ultimately kept may therefore be deducted from the refund.

9. Made-to-measure and personalised pieces

Under Article L.221-28 of the French Consumer Code, the statutory right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.

At MALAM, this includes in particular pieces made specifically:

  • to individual measurements supplied by the customer;
  • in a fabric, colour or combination of materials specifically selected for the piece;
  • with a requested alteration to the design, such as a change to the length, sleeves, cut or another detail.

Choosing a standard size offered for the design, with no other alteration or personalisation, is not treated by MALAM as personalisation that removes the statutory right of withdrawal.

MALAM’s voluntary return policy for personalised pieces

Although pieces made to a customer’s specifications or clearly personalised are excluded from the statutory right of withdrawal, MALAM voluntarily accepts return requests made within 14 days of receipt.

Once MALAM has agreed to the return and the piece has been sent back, 70% of the price of the piece will be refunded. MALAM retains the remaining 30% to reflect the individual nature of the garment and the difficulty of offering it for sale again.

The returned piece must be in a condition suitable for resale. Any loss in value caused by wear or handling beyond a normal fitting may be taken into account.

This is a voluntary commercial policy offered by MALAM and is not an exercise of the statutory right of withdrawal. It does not affect the customer’s statutory rights where an item is faulty or does not conform to the contract.

10. Statutory guarantees under French law

Legal guarantee of conformity

Products sold by MALAM benefit from the French legal guarantee of conformity provided for by Articles L.217-3 et seq. of the French Consumer Code.

MALAM is liable for defects in conformity that existed when the goods were delivered and become apparent within two years of delivery.

Where a lack of conformity is established, the customer has the remedies provided by law, including repair or replacement where applicable. Bringing the goods into conformity is carried out at no cost to the customer.

Where the statutory conditions are met, the customer may also be entitled to a price reduction or termination of the contract.

The legal guarantee of conformity is not a general guarantee against everything that may happen to a garment through use. Normal wear and tear, accidental damage, snags, misuse or unsuitable care are not covered where they do not result from a lack of conformity.

Legal guarantee against hidden defects

Products are also covered by the French legal guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.

This applies where a hidden defect that existed at the time of sale makes the product unfit for its intended use, or reduces its usefulness to such an extent that the customer would not have bought it, or would have paid less for it, had they known about the defect.

The customer has the remedies provided by law, which may include returning the product for a refund or keeping it and obtaining a partial refund, subject to the applicable legal conditions.

11. Routine care, alterations and repairs

Changes required because a customer’s measurements have changed, as well as routine care, normal wear and tear and damage caused through use, are not in themselves covered by the statutory guarantees.

Where technically possible, MALAM may offer alterations, adjustments or repairs to its own creations.

These services may be charged according to the work required. If a service is chargeable, the price will be given to the customer before the work is carried out.

If damage occurs, customers are encouraged to contact MALAM promptly, as continued use may make the damage worse and require a more extensive repair.

MALAM may occasionally choose to carry out an alteration or repair free of charge as a goodwill gesture. This does not create an entitlement to free alterations or repairs in the future.

12. Fabric supplied by the customer

MALAM may exceptionally agree to make a piece using fabric supplied by the customer, subject to inspecting the fabric beforehand and expressly agreeing to use it.

Acceptance depends on factors including the fabric’s type, condition, dimensions, available yardage, pattern and suitability for the intended design. MALAM may refuse fabric that is not suitable for the proposed piece.

Supplying your own fabric does not automatically reduce the price of the garment. Fabric sourced outside the workshop may require additional work or adaptations. The applicable price will be agreed before the order is accepted.

13. Loyalty programme

Where a loyalty programme is available through the shop, its terms and the rules governing how benefits are earned and used are those shown in the customer account or on the relevant pages of the website.

If an order is cancelled or refunded, loyalty benefits relating to the refunded items may be cancelled or adjusted accordingly.

14. Retention of title

MALAM retains ownership of the goods until payment has been received in full.

15. Personal data

Personal data required to process orders, manage customer relations and comply with legal obligations is handled in accordance with MALAM’s privacy policy.

16. Intellectual property

Content on createur-de-mode.net, including text, photographs, images, graphic material and other content, is protected by applicable intellectual property laws. Unauthorised reproduction or use is prohibited, subject to exceptions provided by law.

17. Complaints and consumer mediation

If there is a problem with an order, customers are encouraged to contact MALAM first so that an amicable solution can be sought.

After first submitting a written complaint to MALAM, and if no amicable solution can be reached, consumers may refer the matter free of charge to MALAM’s appointed consumer mediator.

In accordance with the provisions of the French Consumer Code concerning consumer dispute mediation, after contacting MALAM directly and if the response provided does not resolve your complaint to your satisfaction, you may use the following consumer mediation service free of charge:

18. Governing law and disputes

These Terms and Conditions are governed by French law. This does not deprive consumers living in another country of any mandatory consumer protections that may apply to them under applicable law.

If a dispute arises, the parties will first seek an amicable solution. If no solution can be reached, the consumer may bring proceedings before the courts having jurisdiction under the applicable rules.

19. Changes to these Terms and Conditions

MALAM may amend these Terms and Conditions to reflect legal, regulatory, technical or commercial changes. The Terms and Conditions applicable to an order are those accepted by the customer when the order is placed.
