These conditions aim to define the rights and obligations of the Malam shop (referred here as "the Store") and its consumers (referred here as "the Buyers") through the online sale of articles submitted by the Store's website www.createur-de-mode.net

Sales made in the Store's website are subject to these general conditions of sale and any order placed by the Buyer implies acceptance on the content of the policies below.


1. Terms of purchase:

The Store reserves the right to modify or change these Shop Policies.

The items offered for sale in The Store are presented and detailed so that all Buyers are able to identify the essential characteristics of the products they would like to buy (Article L 111-1 of the Consumer Code). The photos illustrating the descriptions of items are provided for information only and are not contractual.

2. Rates:

Prices are in euros and are exclusive of postage. Prices include 20% VAT.
The store reserves the right to revise its prices at any time but is committed to apply the rates in effect at the time of order and, subject to availability on that date.


3. Postage:

The shipping costs are based on the destination of the order.


4. Payment :

The ordered goods are paid in full and without discount at time of checkout. The method of payment is chosen by the Buyer from those offered in the online shop:

  • Credit card in Euros. To access this payment method, the Buyer must be browsing the website in Euros. Payments are made securely through Prestashop Checkout. The details of your credit cards are encrypted with SSL (Secure Socket Layer) and do not travel unencrypted through the network. The Store does not have access to details disclosed. As a result these details are not stored on the server and are asked again for each new transaction on the site. 
  • PayPal account or Credit card via PayPal . Payments are made securely through PayPal. The details of your credit cards are encrypted with SSL (Secure Socket Layer) and do not travel unencrypted through the network. The Store does not have access to details disclosed. As a result these details are not stored on the server and are asked again for each new transaction on the site.
  • Bank transfer in Euros. To access this payment method, the Buyer must be browsing the website in Euros. (The Buyer has 10 days to send the payment by transfer. After this period any unpaid order will be canceled.)

5. Shipment of the order - Delivery:

All orders are shipped by La Poste with tracking (Colissimo) for France and Recommended International Shipping or Colissimo for other countries.

The items listed on the site are in stock or custom made and orders are processed daily.
For in stock items, the expedition is made within 1 business day upon receipt of payment.
For custom-made items, the Buyer selects a fabrication time at checkout. This fabrication period starts upon reception of payment. The expedition date is, at latest, the first business day after the end of the fabrication time.

The delivery period depends of the Post Office. Generally, for France, delivery is between 48 and 72 hours from the date of dispatch. For Europe there should be a period of about a week.

In all cases, the Buyer receives an email confirming expedition of their order.
Shipments to countries outside the European Union may be subject to import taxes or custom fees. Buyers are solely responsible for these taxes or fees, which amount the Store cannot know in advance. For more information, please refer to your local Customs agency.


6. Returns and refunds :

Pursuant to Article 121-16 of the Consumer Code, the Buyer has a period of 14 days from receipt of his order to return the product purchased. Here is a withdrawal form to complete and send back via post or email.

The right of return will be given only if the items returned on time are not worn, not stained, and in perfect condition for resale.
Please note that this right of return is only applicable to items that have not been custom made*, as per legislation - that is, only on in-stock items.

The costs of return, with a tracked delivery, are to be borne by the Buyer. No "paid by receiver" shipments will be accepted by the Store.

Against the party in respect of the above procedure, the Store undertakes to refund or exchange the product within a maximum period of 14 days following receipt of the returned merchandise.

* For custom orders, should the Buyer wish to return it for a refund instead of an alteration, 30% of the total order, excluding shipping costs, will be kept by the Store, excepted in case of a mistake made by the Store.
However, the cost of services linked to the order, as the "express" fabrication time options, are non-refundable, and will be kept by the Store in their integrality.
7. Loyalty program :
Loyalty points are given for each item ordered at the normal price in the online shop, since January 20th, 2019. Points are not given for purchases made via Guest Checkout.
Loyalty points associated to an order are validated upon shipment of the order. In case of a return or order cancellation, the associated loyalty points or purchase voucher generated from them are also cancelled. Loyalty points are valid for 400 days.
Loyalty points can be exchanged for a purchase voucher valid on all the online shop. An order partially paid with a purchase voucher will generate loyalty points according to the amount remaining to pay after application of the voucher.
The virtual value of each loyalty point can be changed at any time, for any reason. The amount of the purchase voucher generated by exchanging loyalty points depends on the virtual value of a loyalty points at the time of their exchange into a purchase voucher.

8. Retention of title:

According to Law No. 80335 of 12 May 1980, the Store retains ownership of the goods delivered until full payment of their price.


9. Devices and Freedoms :

Information requested from the Buyer is required to process and execute their order. Datafiles remain internal to the shop and the Buyer has a right to access and modify the information on them, in accordance with the Data Protection Act of 6 January 1978.


10. Litigation:

These Terms and Conditions are governed by the French law.

Any dispute regarding the interpretation or execution of orders will be reviewed with great care and will be the subject of a proposed settlement immediately. In case of unresolved dispute between the shop and the buyer, only the Commercial Court nearest to the Store will have jurisdiction in the matter.
